Closing the analog hole

I read once that just as its legal to record your TV signals with a VCR, its also legal to record HDTV. However its illegal to produce a device which records HDTV. With all the talk about "anti-circumvention" laws, is this type of law "circumventing" the legality of recording HDTV? This article discusses some of the issues in this area.
